Mortgage from C. W. Lander to Josiah Sturgis [manuscript].

              This Indenture, Made the Sixteenth day of September
in the year of our Lord One Thousand Eight Hundred and Seventy one
Between C.W. Lander, of the County of Contra Costa, State of
California the part of the first part, and Josiah Sturgis
of said County and State party
of the second part,
Whereas, The said party of the first part is justly indebted
to the said party of the second part, in the sum of five hundred and fifty Dollars, with interest on said sum at the rate
of two per cent per month from June 29th 1870, until paid; and the further sum of two hundred Dollars with interest on said
sum at the rate of two per cent per month from the 16th day of July 1870 until paid, both principal and interest
to be paid in the gold coin of the United States - - - - 
secured to be paid by two certain promissory notes bearing date and
in the words and figures as follows, to wit;  Martinez June 29th 1870, $550.  On demand, for value received
I promise to pay to Josiah Sturgis, on his order the sum of Five Hundred and fifty Dollars in United States Gold Coin
with interest payable in U.S. Gold Coin at the rate of two per ct per month from date until paid.  C.W. Lander
Martinez July 16th 1870  On demand for value received I promise to pay Josiah Sturgis
or his order, Two Hundred Dollars with interest at the rate of two per cent per month from date
until paid, both principal and interest to be paid in the Gold Coin of the United States.  C.W. Lander
as by the said two promissory notes reference being thereunto had, may more fully appear,
Now this Indenture Witnesseth, That the said party of the first part, for the better securing
the payment of the said sum of money secured to be paid by the said two promissory notes
with interest thereon, according to the true intent and meaning thereof, and also for and in consideration
of the sum of one dollar, to him in hand paid by the said party of the second part, at or before the
ensealing and delivery of these presents, the receipt whereof is hereby acknowledged, has granted,
bargained, sold, aliened, released, conveyed and confirmed, and by these presents does grant, bargain,
sell, alien, release, convey and confirm unto the said party of the second part, and to his heirs
and assigns forever, All
that certain Lot, peice[sic], or parcel of land, situate
in the Town of Martinez in the County of Contra Costa and State
of California, described as follows, to wit; commencing at the
upper and South West corner of the lot of J.F.S. Smith, thence run-
ning along the line of fence Southerly to the arroyo, thence following
the course of the Arroyo del Hambre, Northerly and Easterly to the South
East corner of said Smiths lot, thence along a dividing fence between
said Smith's Lot and this said described land Westerly to the point of
commencement; being the same lot of land formerly occupied by Mr
A. Tennent Senior; being the same land conveyed by S.J. Tennent and
wife to John Tennent by deed bearing date June 21st 1859 and recorded in Vol-
ume 7 Book of Deeds page 351 of the Records of Deeds of Said County and to which
reference is hereby made for more particular description
